Voters Quiet the Drums At the Polls in Colorado

The "constant drumbeat" of complaints about poor connectivity pounding from Colorado communities ended with a climactic crash at the polls on Tuesday. Referenda in 47 communities* - 27 cities and towns; 20 counties - all passed overwhelmingly to reclaim local telecommunications authority. 

Staggering Approval

The landslide victory was no surprise. Last year, nine communities asked voters the same issue of whether or not they wanted the ability to make local telecommunications decisions. That right was taken away 10 years ago by SB 152. Two other communities took up the question earlier this year with 75 percent and 92 percent of voters supporting local telecommunications authority.

A few larger communities, such as Boulder, Montrose, and Centennial, presented the issue to the voters and reclaimed local authority in prior years. This year, most of the voting took place in smaller, rural communities where incumbents have little incentive to invest in network upgrades.

This year, results were similar as the majority of voters supported local measures with over 70 percent of ballots cast. In Durango, over 90 percent of voters chose to opt out of restrictive SB 152; Telluride voters affirmed their commitment to local authority when over 93 percent of votes supported measure 2B. Many communities showed support in the mid- and upper- 80th percentile.

College Station Wants Competition: Finds It In Their Fiber

Elected officials hope competition via city-owned fiber will give businesses and residents some connectivity headway in College Station, Texas.

The community will lease its city-owned fiber to local ISP, WireStar, in order to foster local competition. City Councilmember James Benham told KBTX that community leaders want high-speed connectivity for businesses and residents and want to create a competitive environment to encourage affordable prices. He described incumbent Suddenlink as "not always the best fit," pointing to the need for high-speed access in multi-family dwellings.

WireStar will begin by offering Internet access up to 1 gig download to businesses and large apartment complexes. Expansion to single-family homes will depend on the demand. WireStar is taking a similar approach as iTV3 in Urbana-Champaign - asking potential subscribers to sign up at their website and offering service in areas that show demand.

WireStar will pay more than $21,000 per year plus maintenance fees to lease the city's fiber; the partners have agreed to a 10-year agreement.

The city, located in the east central part of the state, is home to approximately 94,000 people and part of the Bryan-College Station metro where about 229,000 people live. College Station is home to A & M, along with laboratories for a number of research entities such as NASA, the National Institutes of Health, the National Science Foundation and the Office of Naval Research. 

Benham told KBTX:

"Competition is good for prices and for consumers and for businesses and for this case having multiple choices is good for them."

Businesses in Fort Collins, Colorado, Advocate for Local Authority

As the city of Fort Collins prepares for a November ballot issue seeking to reclaim local telecommunications authority, local business leaders are articulating their support. Walt Lyons, the owner of a Fort Collins-based video production company and member of the Fort Collins Citizens Broadband Committee, believes slow broadband access should be a central priority for this city of more than 150,000:
“This is more important than widening I-25,” Lyons said. “This is not going to make much difference to me because I’m getting ready to retire. But it will make a difference for my kids and my grandchildren. The kinds of places they will work and what they do will depend upon it."
The city has access to many miles of fiber optic networks as Fort Collins is connected to a ring that the Platte River Power Authority (PRPA) built to connect its four partners: Fort Collins, Loveland, Estes Park and Longmont. At present, only government-owned facilities in Fort Collins can use the fiber network.  Because Colorado State University is among the places that can access the PRPA network, the school’s vice president of IT and dean of libraries, Pat Burns, sees firsthand the enormous gap between the broadband speeds he gets at home versus those available on campus:
“The best service you can buy from the private sector, like to a residence in Fort Collins, is not as good as the crappiest service we deliver on the CSU campus,” Burns said. “It just cripples what can be done.”
A number of Colorado communities have voted to reclaim local authority in the past year. A few places, like Rio Blanco County and Firestone, have moved forward with feasibility studies or are already planning for public investment.

New Michigan Bar Journal Article: "The Internet and Municipal Broadband Systems"

A recent Michigan Bar Journal article by attorney Michael J. Watza, The Internet and Municipal Broadband Systems, provides a quick look at the FCC's Open Internet Order [PDF], the recent ruling on state barriers to municipal networks, and how the two may intertwine in Michigan. Watza's three-pager is a great resource for community groups, legislators, and advocates who want to share necessary information without overwhelming the reader.

In addition to providing summaries of each order, Watza offers hope for places that lack the Internet access they need to prosper. He acknowledges Michigan's first gigabit municipal network in Sebewaing and mentions the possibility of public private partnerships. Having worked with Michigan municipalities on telecommunications issues, he knows that other communities in the Great Lakes State also have their eyes on the future:

However, many communities interested in building their own broadband systems have been stymied by state laws written by and for the influential provider industry that either barred such systems or imposed onerous conditions on them. Michigan is one of a couple dozen states with these laws. By striking down such laws, the FCC has authorized and encouraged a significant economic tool for these communities. And perhaps most importantly, by freeing these communities to build on their own or partner with high-speed, low-cost, Internet-friendly private partners like Google (which has been actively pursuing such systems when incumbent monopoly providers have not), it is clear that the FCC is aggressively supporting rate control by the best alternative option in a free market: competition!

New Video on Economic Development and High-Speed Connectivity in Tennessee

Tennessee Fiber Optic Communities has released another quality video focused on restoring local telecommunications authority. This three minute feature describes the importance of high speed connectivity to local economic development.

The video offers specific examples of businesses that relocated to places like Jackson and Chattanooga, comparing business connectivity in places with municipal networks to areas where high-speed connections from incumbents are costly and hard to come by.

Debate on Municipal Networks by Federalist Society Now Available

Our own Christopher Mitchell recently participated in a debate hosted by the Federalist Society. You can now listen to the debate at the Federalist Society website. We think it offers an intelligent airing of different points of view.

Chris, who is also Policy Director at Next Century Cities, disscussed the role of municipal networks in improving competition, reveiwed reguatory issues, and debated the anticipated legal outcome of February's FCC decision on local authority in Tennessee and North Carolina. He squared off against Charles M. Davidson, Director of the Advanced Communications Law and Policy Institute at New York Law School, and Randolph J. May, President of the Free State Foundation. Both organizations have spoken out against community broadband networks.

Avoid Partisan Fights with a Personal Face on Economic Development

The following commentary comes from Mike Smeltzer, one of the key people responsible for the UC2B network in the Illinois twin cities of Urbana and Champaign. Mike had this comment after a question about how we can elevate local bipartisan conversations from the local level to the state and federal level without getting lost in political bickering. He wrote this and gave us permission to republish it.

The Urbana City Council could be confused for Madison's, while Champaign's Council is far more conservative. I spoke to both of them on a regular basis in the early days of UC2B seeking their support. I learned early on that I could not tell Urbana's Council what they wanted to hear on Monday night, and then change the message to better please Champaign's Council on the next night. Those dedicated public servants watch each other's meetings on the PEG channels.

The only message that rang true with both councils was economic development. That should not come as any surprise, but as we look to elevate the discussion, I believe that we need to personalize that message. Joey Durel does it more eloquently than anyone, but I have heard the same theme from other mayors and elected officials from across the country.

The first time I heard Joey was on a NATOA field trip to Lafayette 4 or 5 years ago. After he served us his home-made gumbo, he told us the bottom line on how a conservative businessman became a leading advocate for Lafayette's fiber broadband system.

Joey saw fiber broadband as his community's best opportunity to create a local business environment that would allow his adult children (and their children) to work and live in Lafayette. There is no greater gift to parents than to be able to participate in the lives of their adult children and grandchildren. Without fiber in Lafayette, Joey was concerned that his kids would have to move away to find jobs after college or high school in order to find rewarding work.

Any parent from any political perspective understands that. I am lucky that both of my daughters live in Champaign. I get to see them and my grandchildren often. Wouldn't it be great if my luck was more generally shared?

Estes Park Moves to the Next Phase; Considering Muni Fiber Network

Back in February, voters in Estes Park, Colorado, enthusiastically reclaimed authority to decide locally on a community fiber network. Now the community is moving ahead by taking a detailed look at deploying a municipal gigabit network.

BizWest reports that a consultant hired to study connectivity in the town of 5,800 recently recommended five possible solutions to the community's poor connectivity problem. The Town Board of Trustees considered a municipal telecommunications utility to be the most promising and passed the issue to city staff for further research.

“Now it’s up to us to thoroughly research the feasibility of the town establishing a broadband service utility, considering our financial and operational abilities and the best interests of the community’s future,” said Mayor Bill Pinkham in a media release.

The Estes Park Light and Power Division give this Rocky Mountain town an advantage because it already has electricity distribution infrastructure, utilty poles, and personnel in place. As part of a regional public power initiative, Estes Park also has fiber connecting it to nearby towns, giving it affordable backhaul to the wider Internet.

The consultant recommended forgoing any television or telephone services to focus on delivering high quality Internet access. The cost of deployment will be approximately $27 - $30 million. With a take rate of 30-40 percent, the community should be able to pay off the investment in 10 - 12 years. 

New York Times Supports Local Authority

In a recent editorial, the New York Times recognized that cord cutting is the wave of the future. They agree with the Coalition for Local Internet Choice, and other advocates for local telecommunications authority that the FCC should take steps to remove barriers to local Internet choice created by states on behalf of cable and telco lobbyists. The Editorial Board notes that laws limiting municipal networks block the ability for consumers to take full advantage of this phenomenon:

Among other things, they should override laws some states have passed that make it difficult or impossible for municipalities to invest in broadband networks.

Even though consumers are moving away from cable TV subscriptions, large corporate providers are making up for losses by an increase in Internet access subscriptions. As a result, they still maintain a significant leverage and consumers still face the same old problem - a lack of competition. Striking down anti-competitive state laws blocking munis would create a healthier balance, argues the Times Editorial Board.

This is an opportunity to respond to customer demand and make policy changes the consumers need, argues the NYTimes. Time to act! 

Customers are clearly saying that they want to watch and pay for TV in a different way. Regulators and media executives ought to heed and respond positively to that message — policy makers by encouraging more competition in the broadband market, and media businesses by making more of their content available online.

Policies for Better Broadband - Community Broadband Bits Podcast Episode 165
