A New Cooperative Model for Fiber to the Farm - Community Broadband Bits Podcast Episode 198

When we launched this podcast in 2012, we kicked it off with an interview from Minnesota's farm country, Sibley County. We were excited at their passion for making sure every farm was connected with high quality Internet access. After the project took a turn and became a brand new cooperative, we interviewed them again in 2014 for episode 99, but they hadn't finished financing. They broke ground 2015 and today we discuss the model and the new Institute for Local Self-Reliance (ILSR) case study that details how they built it. City of Winthrop Economic Development Authority Director Mark Erickson and Renville-area farmer Jake Rieke are both on the board of RS Fiber Cooperative and they join us to explain how their model works. 

We at ILSR believe this model could work in much of rural America, in any community that can summon a fraction of the passion of the citizens from Sibley and Renville counties. Having watched this project for all the years it was being developed, I cannot express how impressed I am with their dedication. And because they own it, I'm thrilled to know that no one can take it away from them.

Dakota County, Cities Reviewing Joint Powers Group for Fiber Network

The publicly owned fiber optic network of Dakota County, Minnesota, and of cities within its borders may soon come under the oversight of a local joint powers board.

David Asp, County Collaboration Engineer, said the County started putting the network together in May of 1998. It has grown from 20 miles in 2005 to 112 miles in 2015, and then to 270 miles in 2016. The network provides speeds of up to 10 Gigabits per second (Gbps) download. This news marks a coming of age for the County’s 10-year-old Internet network which, together with the cities' related infrastructure, now spans 270 miles. The County network serves hundreds of public facilities and operations including county buildings, city halls, libraries, schools and more than 350 traffic control signals.

The County and 11 cities within its jurisdiction are now reviewing whether to approve a limited joint powers agreement that would have them inventory their fiber optic infrastructure to find out "what do we have and what are gaps in the system," said Matt Smith, Dakota County deputy manager. Their second objective is to develop a detailed financing system to operate an integrated Internet network, he said.

Asp said he expects the County and the cities will decide by April whether to take this first step in forming the joint powers alliance.

After these studies, the County and cities are then expected to decide if they want to participate in a broader joint powers agreement that would establish the Dakota Broadband Board. If the answer is "Yes," the joint powers board could begin operations in early 2017, Asp said.

Duties of the Board could include establishing policies, procedures, and pricing on leasing the network’s dark fiber, Asp said. Dark fiber is fiber-optic cable that is laid underground but currently not in use, and thus is dormant, or “dark.”

Dakota County, Dakota County Development Agency, Apple Valley, Burnsville, Eagan, Farmington, Hastings, Inver Grove Heights, Lakeville, Mendota Heights, Rosemount, South St. Paul and West St. Paul are reviewing the initial JPA.

In the nearly two years since we launched this podcast with an interview from Minnesota's rural Sibley County, the project has evolved significantly but the need for better Internet access remains a constant. Today, we interview Coop Vice-Chair Cindy Gerholz and Winthrop Town Manager Mark Erickson to get an update on the fiber-to-the-farm project. The Renville-Sibley Fiber project has transitioned from a municipal project to a cooperative. Local towns and a sizeable majority of townships will together issue an economic development bond to provide seed capital to the coop. UTOPIA, For Better And Worse, Profiled

Since 2008, we have followed and reported on the peaks and valleys that is UTOPIA. Recently, the Salt Lake Tribune ran a series on the regional network. The coverage includes a sampling of the bitter and sweet of the complex relationship between the pioneering network, the state, and the customers it serves.

As many of our readers know, UTOPIA is mired in debt and endless political controversy as Comcast and CenturyLink fund "think tanks" to attack it.  Tony Semerad from the Tribune talked to our own Chris Mitchell:

"When you build a network like this, it takes a minimum of several years of spending a lot of money before you start to get it back from your customers,’’ said Christopher Mitchell

As Christopher goes on to note, a large debt from the beginning to create an open access network is not a favorable situation. Additionally, past management made choices that still negatively impact the network. Constricting legislation at the state level prevents the network from expanding to a more profitable retail market, weakening it even further. Also from the article:

State law requires UTOPIA to operate as a wholesaler, a limitation conceived at UTOPIA’s inception when telecommunications giants such as CenturyLink and Comcast, now called Xfinity, grew wary of plans by Spanish Fork and Provo to get into the cable television business and lobbied state lawmakers for protections.

Some communities express derision at the situations they face regarding UTOPIA, having been left with debt and not yet received the ubiquitous access they anticipated. Some communities, who are still waiting for better subscriber numbers, already see improved economic development and remain patient. Connected communities vary in their satisfaction and level of support:

Community Broadband Bits 9 - Leslie Nulty with ECFiber in Vermont

The ninth episode of the Community Broadband Bits podcast features Leslie Nulty, from the East Central Vermont Fiber Optic Network, commonly called ECFiber. ECFiber is using a unique financing arrangement, wherein debt is sold to those in the community as the network slowly expands. They have already raised over $1 million dollars and are providing services in three towns. The network is ultimately owned by the 23 towns that joined together to form the initiative. Leslie explains the history behind the network, the financing approach, and some lessons for others who want to duplicate it. Leslie has also just appeared on Gigabit Nation along with her husband, Tim Nulty, to discuss their approach. Sibley County Discusses Joint Powers Agreement for Rural Fiber-to-the-Farm

Last night, local officials from all over Sibley County gathered in Arlington to learn about the potential fiber-to-the-farm broadband network they could build as early as 2012. Dave Peters, from Minnesota Public Radio, attended and discussed the meeting on MPR's Ground Level blog.
More than 50 elected officials -- county commissioners, city council members, township board supervisors -- gathered in the Arlington Community Center last night to inch ahead a plan to lay fiber optic lines to every home and business in the county plus those in and around neighboring Fairfax in Renville County. It's an ambitious plan that would require the community to borrow $63 million and then pay off those bonds with revenue from the service. The county-owned operation would offer the usual cable-phone-Internet triple plays, and backers are promising that right out of the gate it would be at a speed of 20 megabits per second, upload and download. That's quite a bit faster than what area residents get now via DSL or cable or wireless.
If the project will move forward, the communities will have to form a Joint Powers Board and seed it with some start-up funds. The next steps will be to do a pre-subscription campaign to get a real sense of how many residents would take service from a new network. Responses are non-binding but will give a better measure of support as well as create an additional sense of responsibility for the project. From Dave Peters:
By the end of February, the 10 governments -- Sibley and Renville counties and the cities of Gaylord, Arlington, Winthrop, Fairfax, Henderson, Gibbon, Green Isle and New Auburn -- will each decide whether they want to create a joint powers board.
The best scenario is that all communities would join. But if one or a few do not, the project may be able to continue as long as some of the remaining communities are willing to take additional risk (which would be rewarded with a higher percentage of net income down the line). As long as the JPA is able to continue, all communities will still be passed by the network and residents able to subscribe. The exception is Sibley County itself; if the County does not join, the project would be hard-pressed to run the fiber out to the farmers and residents outside town limits.

Wired West Towns Start Joining Broadband Coop

A group of towns in rural western Massachusetts, having already decided on a cooperative structure, have now started the process of joining the coop in order to eventually build an open access FTTH network to serve everyone in each of the member towns. Originally, the Wired West towns looked to a similar project in Vermont, East Central Vermont Fiber Network, for guidance but found Massachusetts law did not allow them to use the same joint powers agreement approach. After researching Massachusetts law, they found a law previously used by towns to form "light plants" for electrification. In more modern times, the law had been amended to allow such an entity to offer cable television and telecom services. Of the forty muni light plants in Massachusetts, some four provide telecom services. In order to join the coop, a town has to twice pass a 2/3 vote by those in attendance at a town meeting. The meeting must be no less than 2 months apart and no more than 13 months apart. In talking with folks from Wired West, this approach appears to be unique to Massachusetts. From the Wired West site:
Passing the MLP legislation creates a new town department, and does not require a town to produce or sell electricity. The Selectboard can choose to oversee its MLP department themselves or appoint a three to five member board. This group is responsible for appointing a manager, making decisions around the town’s participation and representation in the WiredWest Cooperative, and filing annually with the State. Creating the MLP incurs no cost to the town. If a town decides to join the WiredWest Cooperative, there will be a membership fee of not more than $1,000 per town.
The coop requires at least 2 towns, but that does not appear to be doubt. The towns to consider it thus far have been enthusiastic - Wired West has a helpful map showing where local towns stand in the process.
