HB 2108 Revised Bill Still A Hot Mess In VA

Even after constituent calls and emails, and a threat from Governor McAuliffe to veto her bad broadband bill, Del. Kathy Byron is trying to shove through her anti-competitive HB 2108. The legislation will prove fatal for local telecommunications authority if it passes. The revised bill is up for a vote in the House Labor and Commerce Committee on Thursday, February 2nd; Byron is Vice-Chair of the Committee.

Here's The New Bill; Same As The Old Bill

If you’re curious to see the text of the new draft, it is now available on Virginia’s Legislative Information System (LIS). If you’re expecting something better than the original text, you will be disappointed. This version holds on to provisions that Byron’s influential friends in the telecommunications industry need to intimidate and lock out competition.

The revised bill still dictates rules on pricing for municipal networks and imposes heavy-handed transparency rules that put any proposal at a disadvantage. The aim is to discourage potential private sector partners who may wish to work with local governments. The new draft maintains broad enforcement provisions, which large, anti-competitive providers exploit as a delay tactic to bury a publicly owned project before it even starts.

Like it’s predecessor, it’s painfully obvious that this version of HB 2108 is a AT&T sponsored tool to scare off any competition.

Another Bad Review

Battle For Broadband In Bradley Top 2016 Newsmaker

Bradley County is the neighbor that time forgot in Tennessee. It sits adjacent to Hamilton County and just a short trek from Chattanooga’s EPB Fiber Optics, but state law forbids the utility from serving residents and businesses there. The Cleveland Daily Banner has followed the broadband struggles in Bradley County and ranked the “Battle for broadband” in the top 10 Newsmakers for 2016.

And So They Wait...And Wait...And Wait

“There are constituents in my district that have waited 20 years [for broadband access],” state Rep. Dan Howell said in February. “What if you had to wait 20 years to get electricity even when they had it next door? That’s what broadband is today.”

The editors and staff writers of the Daily Banner chose the Top 10 and in a recent article described how the fight started years ago and continues today. They review the FCC’s 2015 ruling that preempted state laws preventing EPB expansion into Bradley County and elsewhere and how the 6th Circuit of the U.S. Court of Appeals reversed the decision, which crushed locals’ high hopes.

Bradley County residents have not given up, however. They’ve met with outgoing FCC Chairman Tom Wheeler and have pressed state lawmakers to remove the barrier that keeps them in the last century. A state bill, introduced by Rep. Kevin Brooks, could not get past the House Business and Utilities subcommittee, but the people in Bradley County press on because they have no other option.

And Wait Some More

Their experiences have left them a little jaded; when AT&T announced in August that it would begin serving parts of Bradley County with Fiber-to-the-Home (FTTH), state legislators working on the issue scoffed. They’ll believe it when they see it; us too.

Palm Beach Post Editorial: Connectivity Is A Social Justice Issue

The small city of Lake Worth, Florida, may undertake a free Wi-Fi project in order to boost economic development and ensure Internet access for all residents. The local newspaper and the city’s Community Redevelopment Agency (CRA) support the project. They recognize the potential to connect low-income households throughout the city and the economic development opportunities that can benefit the entire community.

A recent editorial in the Palm Beach Post underscores how connectivity is a social justice issue: lack of access excludes folks from society. The editorial also makes the argument for adding fiber optic cable throughout the city, ensuring high-speed Internet access for all.

Social Justice

Many Palm Beach County residents are considered affluent, but Lake Worth has a poverty rate of 32 percent and poorly-ranked public schools. The editorial breaks down the statistics and points to the Pew Research Center’s figures on the digital divide, which acknowledge a class divide and an educational divide. Ninety-six percent of college graduates use the Internet compared to 61 percent of adults with a high school education or less. Likewise, 99 percent of adults with household incomes over $150,000 use the Internet vs. 78 percent of adult of households with less than $30,00.

“Modern society is so deeply networked that to live outside it is a very steep obstacle to ever getting ahead. It is, as [CRA Executive Director Joan Oliva] told the Post Editorial Board, a question of social justice.”

The Proposed Project 

Lake Worth’s CRA wants free public Wi-Fi citywide, especially in the lowest income areas. To blanket the entire 6.5 square mile city in Wi-Fi would cost approximately $860,000. The city government would pay $640,000 with the CRA providing the remaining $220,000.

CO Editors Want A "Yes": It's Only Logical

As Election Day approaches, people in a number of Colorado communities will be addressing special ballot questions on local telecommunications authority. Editors of the local news source, the Journal, encourage voters in Montezuma County and Dolores to opt out of harmful SB 152 and reclaim authority taken away in 2005.

“That Industry Has Had Its Chance”

According to editors at the Journal, SB 152 may have sounded like a good thing to legislators in 2005, but big corporate providers have not lived up to promises to bring high-quality connectivity to rural Colorado:

More than a decade later, that industry has had its chance. Internet providers have cherry-picked the lucrative markets and left small communities and even more sparsely populated rural areas with substandard Internet services that are far from high speed. Now it is time for the public sector to step out from under SB 152 restrictions.

By our last count, 27 towns and counties will offer voters the choice to opt out, but we may discover more as we continue to research before Election Day. The communities who choose to vote on the measure don’t necessarily have solid plans to invest in Internet access infrastructure, but if they want to work with a private sector partner or on their own, they must first hold a referendum. 

It's Logical

As Election Day approaches, we anticipate more editorials expressing support; local communities are tired of waiting for better connectivity. As stated by the editors here:

Ballot issues 1A and 2A, respectively, allow local governments to investigate the feasibility of providing broadband services as a public utility or as part of a public-private partnership with taxpayer support for infrastructure.

That is logical, because most of us think of the Internet exactly as an essential utility, right along with electricity, gas and water.

The need is obvious. County voters, vote “yes.” Dolores voters, check the “yes” boxes on both 1A and 2A.

Examining Connectivity Alternatives: Op-Ed In Rochester

When the Rochester Post-Bulletin published Christopher Mitchell’s opinion piece in August, it wasn’t only because he is an expert on municipal networks. Christopher’s interest in all things geeky started in Rochester - he went to Rochester Mayo High School.

A Budding Idea

For the past few years, various elected officials, and member of the community-at-large have expressed dissatisfaction for services offered by incumbent Charter Communications. In addition to poor services, City Council members have faced complaints from constituents about awful customer service. Over the past year, the community began showing that they will not abandon the idea of publicly owned Internet infrastructure.

The city, home to the world-class Mayo Clinic, is a hub of healthcare discovery. As medical technology becomes more intertwined with fast, affordable, reliable connectivity, Rochester’s expensive and lackluster incumbent Internet providers are showing that they just aren’t cutting it.

Local Support And Early Analysis

In June, the Post Bulletin Editorial Board published their support for a review of the options:

We'd encourage the council and Rochester Utilities Board (RPU) board to make every effort to explore the costs and benefits of installing municipal broadband Internet services as a way of ensuring our community stays effectively connected to the world around it.

Considering Rochester's economic dependence on science and technology, having access to the highest speeds possible is crucial to the city's future. Unfortunately, existing services lag behind those being offered in other cities, putting Rochester's businesses and residents at a competitive disadvantage.

Many questions and concerns remain, but finding answers is the best way for the city to make sure it is serving the needs of its constituents to the fullest.

Local Media Covers The MN "Donut Hole" Phenomenon: Video, Editorial

As Minnesota's Legislature decides on funding for the state's Border-to-Border Broadband Development Grant Program, local media is calling on state leaders to prioritize local connectivity in the Capitol Chambers. This year, Governor Dayton's office is recommending allocating $100 million to the program.

Blended Is Better

In the past, the Border-to-Border Broadband Development Grant Program has granted funding to areas of only the greatest need, which has resulted in Internet infrastructure deployment in very rural areas. That's great for municipalities, businesses, and residents in those areas who certainly need and deserve better connectivity. Towns where there is some coverage, such as old DSL networks, have typically not qualified. As a result, rural areas of the state are developing "donut holes" of inadequate connectivity. In the long term, this could spell disaster for these towns because businesses have no reason to locate in places where they can't get the Internet access they need for operations. A blended approach will allow investment in both unserved areas and areas where some networks already exist so centers of economic activity can still compete with their neighbors.

Boston Globe: Build A Muni

The Editorial Board from the Boston Globe recently kicked off a series titled "The Cutting Edge of the Common Good." The editors intend to offer suggestions for how to create a prosperous city through ideas to benefit Boston's 4.7 million residents. 

Their first proposal? Build a municipal fiber network.

In the editorial, the Board point out how the city has always been a cutting edge leader, from Revoluntionary War to same-sex marriage. But when it comes to developing the tech sector, the "City on a Hill" is being edged out by Chattanooga, Lafayette, Louisiana, and Cedar Falls, Iowa. High-tech innovators are flocking to communities with municipal fiber networks.

As the Globe notes, connectivity could be better in Boston:

The truth is that our tech infrastructure is in the same dismal shape as our roads and bridges. Boston, like a majority of American cities, pays more for slower Internet service than our international peers. If Boston is to remain a global hub of innovation — and on the “cutting edge of the common good,” as Mayor Martin J. Walsh promised in his State of the City address last month — it should build a citywide fiber-optic network that allows each residence and business an onramp to the information superhighway of the future.

Even though the city has its own conduit network and significant fiber assets, residents and businesses must seek service from large private providers. The Globe Editors believe the city should rethink the current approach:

But the City of Boston should not gamble its future competitiveness in a Mountain View lottery, nor should it entrust such vital infrastructure entirely to private hands.

The private market would be the ideal solution in an ideal world, but in Boston the market has failed.

New York Times Supports Local Authority

In a recent editorial, the New York Times recognized that cord cutting is the wave of the future. They agree with the Coalition for Local Internet Choice, and other advocates for local telecommunications authority that the FCC should take steps to remove barriers to local Internet choice created by states on behalf of cable and telco lobbyists. The Editorial Board notes that laws limiting municipal networks block the ability for consumers to take full advantage of this phenomenon:

Among other things, they should override laws some states have passed that make it difficult or impossible for municipalities to invest in broadband networks.

Even though consumers are moving away from cable TV subscriptions, large corporate providers are making up for losses by an increase in Internet access subscriptions. As a result, they still maintain a significant leverage and consumers still face the same old problem - a lack of competition. Striking down anti-competitive state laws blocking munis would create a healthier balance, argues the Times Editorial Board.

This is an opportunity to respond to customer demand and make policy changes the consumers need, argues the NYTimes. Time to act! 

Customers are clearly saying that they want to watch and pay for TV in a different way. Regulators and media executives ought to heed and respond positively to that message — policy makers by encouraging more competition in the broadband market, and media businesses by making more of their content available online.

Fort Collins Local Media Endorses Muni Option

Communities all over Colorado have voted to reclaim local authority during the past year. Even though elected officials in Fort Collins are exploring the municipal network option, the City Council has yet to present the question to voters. Editors at the local news outlet, the Coloradan, recently expressed their support for a municipal broadband network, urging community leaders to let voters decide.

The Editorial Board focuses on the benefits Fort collins can expect from increased economic development, telemedicine capabilities, and relieved congestion from telecommuting. They see Internet access as one of the essential services cities provide such as water and electricity. The Editorial Board notes that city leaders have already budgeted $300,000 to create a strategic plan that includes community broadband.

The Board acknowledges that there are many unanswered questions - funding, cost, motivation for a deployment. Yes, questions need to be answered along the way, but it is time to move forward:

One hurdle is a 2005 state law that bans municipalities from starting their own telecommunications service, however, either a local vote or a federal waiver could override the law.

The time is now to sidestep the ban and approve municipal broadband.
