AT&T Lobbying Likely to Increase Wisconsin School, Library Telecom Costs

The University of Wisconsin recently withdrew from its contract with WiscNet, threatening the future of the network. Stop the Cap! reports the University bowed under pressure from Republican lawmakers and threats of litigation from the likes of AT&T, CenturyLink, and the Wisconsin State Telecom Association (WSTA). Costly litigation could interrupt UW's research and educational work and UW must consider its relationship with the legislature and the future of state funding.

Once again Republican legislators chose the powerful telecom lobby over taxpayers. WiscNet is a buyer coop that allows schools and libraries to keep their telecom costs lower by working together. Weakening WiscNet means the schools and libraries may have to pay higher fees just to maintain the same level of service. 

The telecom industry makes generous contributions to most Wisconsin lawmakers, but Republicans in particular have been enthusiastic about knee-capping any perceived threat to AT&T's monopoly in much of the state. With WiscNet in the cross hairs, ALEC legislators in Wisconsin can expect renewed campaign support. Senator Paul Farrow and Representative Dean Knudson, spearheading efforts to dismantle WiscNet, receive sizeable donations from WSTA, CenturyLink and TDS Telecom.

If WiscNet cannot recover from the loss of UW, local taxpayers will be the ultimate losers as they have to pay more to keep essential institutions connected. WiscNet provides economical broadband service to members all across the state and ample evidence suggest higher rates accompany private service. From the Stop the Cap! article:

Responding to "Crazy Talk" - Community Broadband Bits Episode #50

For our 50th episode, we're trying something new: Lisa and I respond to three common claims made by opponents of community owned networks. We owe these three particular arguments to the Executive Director of the trade association of Wisconsin telephone companies. Each of the clips we respond to come from claims he made at a workshop at the 2012 WiscNet conference. We play a short claim by him and then Lisa and I respond to it. For this show, we look at claims that telephone companies already serve everyone with broadband, that the rapid iteration of mobile phone technology delegitimizes public sector investment in networks, and that public investment "crowds out" private investment. These are very common arguments offered every time a community considers building its own network, but they are quite weak. As Joey Durel, Mayor of Lafayette, so often reminds us, the big companies don't win by having good arguments. They win by buying steaks and football tickets -- lobbying. Waukesha's WECAN Now Provides 1 Gbps to the Internet

Waukesha, Wisconsin now offers an ultra-fast connection for educational and government members. WiscNetWire reports that the region's Community Area Network (CAN) obtained 1 gigabit Internet capability in August.

We have reported on Wisconsin's efforts to expand connectivity using the CAN model of collaboration. The people of Wisconsin are hard at working connecting to each other with a combination of stimulus funding and matching local contributions.

WECAN (the Wakesha Community Area Network) now connects Carroll University, Waukesha County Technical College (WCTC), Waukesha Public Schools and the City of Waukesha. The 1Gbps connection to the Internet is now available to the entities on the network. According to the WiscNetWire article:

On August 30th, WECAN finished work on a new fiber-optic connection giving each organization a 1 Gigabit connection to the Internet. Steve Schlomann, Chief Information Officer for the School District of Waukesha, compares this upgrade to “opening a 10 lane freeway where we once had a single lane road.”

WECAN started as an idea advanced by WCTC and Carroll University. The two entities established relationships within the private and public sectors. The initial fiber network was built in 2011. From the article:

More recently, the School District of Waukesha and the City of Waukesha also joined WECAN. The school district and city worked with CableCom LLC, Cisco, Heartland Business Systems, Multimedia Communications and Engineering of Green Bay and WiscNet to build and leverage their connection. With the addition of these members, the network, which was intentionally designed to allow other local institutions to easily join and share in the benefits, is currently being shared by four organizations with intentions to continue growing.

The ease with which other groups will be able to connect to WECAN should encourage other entities to participate. Current members of the network report cost savings and increased efficiency as a benefit of the collaborative nature of the project.

Collaboration Alive and Well In Wisconsin Broadband Expansion

Wise people say that collaboration often leads to a better result than individual efforts. Recently, I was reminded of the benefits of different levels of collaboration, as they relate to community networks, in two separate articles about fiber-optic expansion in Wisconsin.

First, is a recent Randy Happel article in Trenchless Technology, about how UW-Extension is working with a private telecommunications network design, engineering, and construction firm to expand the fiber-optic landscape in their state.  Over thirty-seven million dollars in stimulus funding for UW-Extension through the American Recovery and Reinvestment Act (ARRA) is allocted as part of the Broadband Technology Opportunities Program (BTOP). The result will be a 630-mile fiber-optic network to help improve connectivity in Wisconsin.

CCI Systems, the private partner, has been around since 1955 and has a history in CATV networks. From the Happel article:

“Public-private partnerships are our expertise,” says Dave Mattia, director of operations for CCI Systems. “We are also quite adept at working within the parameters for the federal funding programs. Our experience and expertise in designing and building broadband, fiber-optic communications networks are great assets to our partners.”

“Our approach is extremely disciplined and methodical,” says Cory Heigl, director of business development for CCI Systems. “Collaboration, listening and cooperation are critical to maximize project efficiencies. Other firms may start by choosing a technology. We begin by listening and identifying the desired end result. Our approach streamlines the process and has proven most effective in securing funding, especially grants and stimulus money.”

After fiber installation is complete, scheduled for June 2013, CCI Systems will shift from installation and design to maintenance and support. After the long battle with AT&T, working with a cooperative partner like CCI Systems must be a welcome relief for UW-Extension.

Milwaukee Contemplates Its Chance to Be The Next Chattanooga

A recent article by Chloe Morrison on Nooga.com, highlighted the inquiries and envy from all over the globe about Chattanooga's awesome community fiber network. According to Rick Barrett of the Journal Sentinel, Milwaukee is one of many admirers with wandering eyes that keep taking a peak at Tennessee. No wonder! The "Gig City" has set the gold standard for connectivity. Additionally, the city has cleverly capitalized marketing the opportunities to spread the word about their network and to attract more economic opportunities.

Collaboration is the popular theme that is associated with development. When looking back in Wisconsin, collaboration seems rare to find. We have reported extensively on AT&T's attempts to instigate discord, drag out legal proceedings, and fatally halt the possibility of community owned broadband in Wisconsin.  If the Badgers want to compete in the digital economy, as they claim they do, they will have to stop listening to the big cable and DSL companies:

Only a few Internet users, such as a hospital or a large company, would currently benefit from the full capabilities of a gigabit network that can move large amounts of data at incredible speeds. It's like buying a Jaguar when a Ford Focus would be perfectly adequate, said Andrew Petersen, spokesman for TDS Telecom in Madison. (from the Barrett article.)

We have all read this tired comparison before and it still seems silly from a technological perspective. Planning for the future is critical when investing in essential infrastructure. Technological advancement moves at a fast pace, rather than an adequate pace.

Consider this assage from the Nooga article and consider how many of the benefits of a next-generation networks TDS would actually care about:

Rural Wisconsin Residents Struggle to Connect to the Internet

A group of rural residents living east of Madison, Wisconsin, gathered near Portage of Columbia County to discuss their lack of affordable high speed access to the Internet. These are people for whom slow, overpriced DSL would be an improvement. Lack of access to the Internet is a drain on rural economies -- their real estate market suffer and they are unable to telecommute, when they would benefit more from it than most who do have the option. They lack access to long-distance education opportunities in a time when the cost of gas makes driving to school prohibitively expensive. Andy Lewis, who has been working with the Building Community Capacity through Broadband Project with U-W Extension, was on hand to discuss some of the lessons learned through their work, which is largely funded by a broadband stimulus award. The incumbent providers encouraged residents without access to aggregate their demand and create petitions to demonstrate the available demand. Of course they did. And if CenturyLink decides it can get a sufficient return on its slow and unreliable DSL, they will build it out to some of those unserved areas. This is a "damned if you do, damned if you don't" scenario for rural residents. DSL was starting to be obsolete years ago. The better solution is finding nearby cooperatives and munis that will extend next-generation networks that can provide fast, affordable, and reliable access to the Internet. Getting a DSL to a town will do very little to attract residents and nothing to attract businesses. It is a 20th century technology in a rapidly evolving 21st century world. The Beaver Dam Daily Citizen covered the meeting, which eventually turned away from how to beg for broadband to how they can build it themselves:
But several attendees asked why the government can't play a role in making high-speed service available everywhere, in the same way that the government helped bring about rural electrification and telephone service.
This is a very good question. They may decide not to follow that path, but given the importance of access to the Internet, they should look at options for building a network that puts community needs first.

Community Broadband Fills Needed Gap in Wisconsin

Another video from the University of Wisconsin Extension Service's broadband stimulus project, Building Community Capacity through Broadband, which we have been covering here.

This video looks at why these community networks are needed and how private partners look at the project.  These communities are often limited to much slower networks that are nonetheless priced higher than connections in larger cities.  Community networks benefit residents and local businesses by creating competition, offering higher capacity connections, and lowering prices, often by working with private sector partners.

Reedsburg Finally Launches Rural Expansion

Reedsburg Utilites, the owner and operator of a muni FTTH network north of Madison, Wisconsin, is finally moving forward on a project to connect rural areas of Sauk County. Last year, Reedsburg received a broadband stimulus award to expand its network but hit a series of stumbling blocks that called the project into question. The first problem is a common one when taking federal money -- Davis-Bacon wage rules. The bids from contractors were higher than expected because the appropriate wages according to the law are sometimes based on flawed data. In this case, contractors based the wages on highway construction rates, which increased the costs of the project by 50%. In other cases, we've heard of Davis-Bacon setting rates in rural areas based on urban wages, making projects harder to finance. Reedsburg apparently found a work-around (after first seeking a waiver from the provision):
Instead of accepting the bids, the utility decided to bid out rental contracts worth about $4 million to various companies, because the utility would not have to pay federal rates for temporary labor.
Then the prices for fiber-optic cable and duct rapidly increased due to the increase in demand from stimulus projects and the Japan earthquake. Finally, they were stuck waiting for final approval from RUS. Now they are moving forward with the $9.5 million project ($5.2 million grant, the rest in revenue bonds), which is good given the apparent demand they are seeing for the service:
Douglas [Reedsburg Utilities Marketing and Media Specialist] said the utility has seen a very high rate of interest in the new service. "I would say nine out of the 10 people I've talked to are on board, out of everyone we've met with so far," Douglas said.

AT&T Group's Lawsuit in Wisconsin Fails

Yet another court has ruled against an incumbent telephone or cable company that filed a lawsuit to block any threat to their continued monopoly in America's communities. Access Wisconsin, an AT&T dominated trade group, has been trying to stop communities in Wisconsin from building their own next-generation networks to serve schools and libraries that AT&T has long neglected with slow, overpriced, broadband connections. A local judge has dismissed this blatantly anti-competitive attempt to stop communities from building the networks they need.
Wisconsin Independent Telecommunications Systems, operating as Access Wisconsin, sued the UW Board of Regents in July in an effort to stop a $32.3 million fiber optic network to Platteville, Wausau, Superior and the Chippewa Valley region. The lawsuit also named WiscNet, CCI Systems Inc. and the state Department of Transportation. ... The grant — made available through federal stimulus funds — will build high-speed Internet fiber to anchor institutions such as libraries, schools and government, health care and public safety buildings.
A press release from the UW-Extension office that organized the Building Community Capacity through Broadband program, funded by the broadband stimulus program, notes:
“This work by the University of Wisconsin-Extension and our many community partners is vital to the future of the Wisconsin economy,” said Ray Cross, chancellor of the University of Wisconsin-Extension and University of Wisconsin Colleges. “I hope that now government, the university, private businesses and communities in every corner of the state will be able to work together to assure Wisconsin is connected to the global economy.”
Remember that these lawsuits are rarely intended to be won.
